SI 2022/547
The Fire Safety (England) Regulations 2022.
The Fire Safety (England) Regulations 2022 put duties on the responsible person for multi-occupied residential buildings in England. Regulation 8 makes floor and flat wayfinding signage a legal requirement in high-rise residential buildings from 23 January 2023.
For signage and wayfinding
What it asks of your signs
- 01Applies to existing as well as new high-rise residential buildings: two or more sets of domestic premises and at least 18m high or at least 7 storeys.
- 02Regulation 8 requires clear markings of floor identification and flat identification, designed and located in line with Approved Document B Volume 1 (paragraphs 15.13 to 15.16).
- 03Markings go on each landing within the stairways and in the lift lobbies, and must be visible in low level lighting or when lit by a torch.
- 04The duty sits with the responsible person under the Regulatory Reform (Fire Safety) Order 2005, so freeholders, managing agents and build to rent operators are the client for retrofit packages.
- 05The Home Office says other existing multi-occupied residential buildings do not have to retrofit, but new buildings over 11m must have the signage through Approved Document B.
- 06Ongoing maintenance of the signs falls under the existing Fire Safety Order duties for the life of the building.
What the regulations do
The regulations were made on 17 May 2022 under the Fire Safety Order 2005 and came into force on 23 January 2023. They implement recommendations from Phase 1 of the Grenfell Tower Inquiry. Most of the duties apply only to high-rise residential buildings, defined in regulation 3 as buildings with two or more sets of domestic premises that are at least 18m above ground level or have at least seven storeys. Height is measured to the top storey as in Appendix D of Approved Document B, storeys below ground are ignored, and a mezzanine counts if it is at least half the floor area of the largest storey above ground.
- Regulation 4: install and maintain a secure information box, checked at least annually.
- Regulation 5: record the design and materials of the external walls and share it with the fire and rescue service.
- Regulation 6: prepare floor plans and a single page building plan, kept in the secure information box.
- Regulation 7: monthly checks of lifts and essential firefighting equipment, with faults reported.
- Regulation 8: wayfinding signage.
- Regulations 9 and 10 reach further, to any building with two or more sets of domestic premises and common parts: fire safety instructions for residents, and fire door information, with quarterly communal fire door checks and annual best endeavours checks of flat entrance doors where the building is over 11m.
Regulation 8 in detail
Regulation 8 does not set its own sign specification. It defines the markings as identification designed and located in accordance with the guidance in Volume 1 of Approved Document B, and the legislation's footnote points to paragraphs 15.13 to 15.16. In effect, a design guide written for new blocks over 11m became a legal standard for every existing block of 18m or seven storeys and above in England.
So the specification is the ADB one: Floor X signs with lettering of at least 50mm and a floor numeral of at least 75mm, mounted between 1.7m and 2m, with Flats X-Y indicator signs directly beneath and arrows where flats run in more than one direction, all on a contrasting background that reads in low light or torchlight.
The Home Office published a factsheet on regulation 8 in May 2022. It confirms the 18m or seven storey scope, notes that the requirement goes further than the Inquiry recommendation by applying to existing buildings, and states that other existing multi-occupied residential buildings are not required to retrofit, although responsible persons may wish to consider it. It describes itself as a factsheet, not guidance.
Practical points for a retrofit
- Survey every landing and lift lobby, including basements and any roof plant level the stair serves.
- Agree the floor numbering with the residents' numbering first. Where an existing scheme says Level 1 but residents and post use Floor 1, the regulation follows what residents use.
- Check visibility from the top step of the stair and from the lift car before fixing.
- Record the signage in the building's fire safety file so the responsible person can evidence compliance.
Other jurisdictions
These regulations apply in England only. Wales, Scotland and Northern Ireland handle existing building duties separately. For new buildings, Northern Ireland's Technical Booklet E and Scotland's domestic handbook carry their own floor and flat sign guidance, and Ireland's TGD B covers storey identification in firefighting stairs and lobbies.
Editions and history
Made 17 May 2022, laid 18 May 2022, in force 23 January 2023. Regulation 12 requires the Secretary of State to review the regulations at intervals of no more than five years.
